These Terms govern your use of Aigirlfriend at aigirlfriend-smart.com. Please read them carefully before chatting with our AI girlfriends.

1. Agreement to Terms
Welcome to Aigirlfriend. By accessing or using aigirlfriend-smart.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please stop using Aigirlfriend immediately. These Terms form a binding legal agreement between you and Aigirlfriend, governing every interaction with the Service, including browsing our models, chatting with AI girlfriends and using premium features.
2. Eligibility and Age Requirement
Aigirlfriend is strictly for adults. You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is higher, to use Aigirlfriend. By using the Service you represent and warrant that you meet this requirement. Aigirlfriend reserves the right to request age verification at any time and to suspend accounts that appear to violate this requirement.
3. Nature of the Service
Aigirlfriend is an entertainment platform that allows users to chat with fictional AI-generated characters ("AI girlfriends"). All AI girlfriends on Aigirlfriend are simulated and do not represent real people. Any resemblance to a real person is coincidental. Conversations produced by our AI girlfriends are generated content and should be treated as fictional roleplay, not as advice, factual information or professional counselling.
4. User Accounts
To access certain features of Aigirlfriend you may be required to register for an account. You agree to provide accurate information, keep it up to date and safeguard your login credentials. You are responsible for all activity that occurs under your account. Aigirlfriend is not liable for any loss or damage arising from unauthorised access resulting from your failure to protect your credentials.
5. Acceptable Use
When using Aigirlfriend you agree not to: (a) use the Service for any unlawful purpose; (b) attempt to extract, scrape or reverse engineer any part of the Service; (c) upload malicious code; (d) impersonate any person or entity; (e) attempt to bypass any content moderation systems; (f) use Aigirlfriend to produce content depicting minors, non-consenting individuals or otherwise illegal content. Violating this section may result in immediate account termination.
6. Content Standards
Aigirlfriend enforces strict content standards. Any request that involves minors, real identifiable persons without consent, hateful content, credible threats of violence or content that violates applicable law is prohibited. Aigirlfriend uses automated and human review systems to enforce these standards.
7. Intellectual Property
All content on Aigirlfriend – including model artwork, text, character descriptions, logos, code and design – is owned by Aigirlfriend or its licensors and is protected by intellectual property laws. You may not copy, redistribute, resell or create derivative works from any Aigirlfriend content without prior written consent.
8. User Content
You retain ownership of messages and other content you submit to Aigirlfriend. By submitting content, you grant Aigirlfriend a worldwide, non-exclusive, royalty-free license to store, display, adapt and use that content to operate and improve the Service, including model quality and safety systems.
9. Subscriptions and Payments
Aigirlfriend may offer premium features on a subscription or one-time payment basis. Prices are displayed at the point of purchase. All fees are non-refundable except where required by law. You are responsible for taxes applicable to your purchase. Subscriptions renew automatically unless cancelled before the renewal date.
10. Free Trials
Aigirlfriend may offer free trials for premium features. Unless cancelled before the trial ends, your account will convert to a paid subscription at the standard rate. You can cancel at any time from your account settings.
11. Cancellation and Refunds
You can cancel your Aigirlfriend subscription at any time. Cancellation stops future renewals but does not refund the current billing period unless required by law. If you believe you were charged in error, please contact support@aigirlfriend-smart.com.
12. Third-Party Services
Aigirlfriend integrates with third-party providers for payments, analytics and content delivery. Those services are governed by their own terms and privacy policies. Aigirlfriend is not responsible for the availability or content of any third-party service.
13. Privacy
Your privacy matters to Aigirlfriend. Please review our Privacy Policy to understand how we collect, use and protect your personal information. By using Aigirlfriend you consent to the processing described in that policy.

Aigirlfriend uses cookies and similar technologies to keep the Service running smoothly, personalise your experience and analyse traffic. See our Cookie Policy for details. You can manage cookie preferences from the consent banner shown on your first visit.
15. Prohibited Territories
You are responsible for ensuring that use of Aigirlfriend is legal in your jurisdiction. Aigirlfriend may restrict or block access from territories where the Service is not permitted.

Aigirlfriend is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Aigirlfriend does not warrant that the Service will be uninterrupted, error-free or free of harmful components. Any reliance on content generated by Aigirlfriend is at your sole risk.
17. Limitation of Liability
To the maximum extent permitted by law, Aigirlfriend and its team shall not be liable for indirect, incidental, consequential, special or exemplary damages arising from your use of the Service. Aigirlfriend total liability for any claim relating to the Service is limited to the amounts paid by you in the twelve months preceding the claim.
18. Indemnification
You agree to indemnify and hold harmless Aigirlfriend, its owners, employees and affiliates from any claim, loss or expense arising out of your use of the Service, your breach of these Terms or your violation of any law or third-party right.
19. Suspension and Termination
Aigirlfriend may suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will do so.
20. Changes to the Service
Aigirlfriend continuously improves. We may add, modify or remove features, models and content at any time without notice. Aigirlfriend is not liable for any loss caused by such changes.
21. Changes to These Terms
Aigirlfriend may update these Terms from time to time. Material updates will be announced on the Service. Continued use of Aigirlfriend after changes take effect constitutes your acceptance of the updated Terms.
22. Feedback
If you send Aigirlfriend suggestions or feedback, you grant Aigirlfriend a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
23. Governing Law
These Terms are governed by the laws of the jurisdiction where Aigirlfriend operates, without regard to conflict of laws rules. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of that jurisdiction.
24. Dispute Resolution
Before filing any formal claim, you agree to first contact Aigirlfriend and try to resolve the dispute in good faith. Most issues can be handled quickly via support@aigirlfriend-smart.com.
25. Class Action Waiver
To the extent permitted by law, you agree that any dispute with Aigirlfriend will be resolved on an individual basis and not as part of a class, consolidated or representative action.
26. Force Majeure
Aigirlfriend is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, war, labour disputes, network outages and government actions.
27. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect and the invalid provision will be replaced by an enforceable provision that most closely reflects the original intent.
28. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Aigirlfriend regarding the Service and supersede any prior agreements.
29. Assignment
You may not assign or transfer these Terms without the prior written consent of Aigirlfriend. Aigirlfriend may assign these Terms freely in connection with a merger, acquisition or sale of assets.
